During this session attendees will:

Enforcement and Employment Enforcement Coalition

The EEEC is a labor, employment, and licensing law enforcement unit that is conducting unannounced inspections on such matters as labor law and health and safety violations.

The EEEC targets types of businesses it suspects may not be in compliance, such as agriculture, construction, car wash, auto body, garment making and pallet making.

The EEEC is comprised of investigators and inspectors from the:

  • Labor Commissioner’s Office
  • Cal/OSHA
  • Employment Development Department (EDD)
  • Contractors State License Board (CSLB)
  • U.S. Department of Labor (DOL)

The presentation will include:

  • What is the EEEC and how it impacts your business
  • How to avoid heavy violation fines by increasing safety in your workplace
  • Top 5-10 violations identified
  • How to better prepare for an unscheduled inspection

The Interaction Between Workers' Compensation and FEHA

This seminar will deal with the relationship between workers' compensation claims and the employer’s obligation to complete the interactive process under Fair Employment and Housing Act.

We will discuss how the employer has to complete the interactive process in situations involving both temporary disability and permanent disability.

You will learn about:

  • Family Medical Leave Act (FMLA)
  • Reduce your Return to Work process liabilities

David Dorame is the Director of the Economic and Employment Enforcement Coalition and brings over 20 years of experience with the Department of Industrial Relations, Division of Labor Standards Enforcement. He oversees and coordinates all EEEC sweep operations as well as all outreach educational programs. He has a very comprehensive knowledge and understanding of all aspects of the state wage and hour laws, health and safety requirements, state and federal discrimination laws, whistleblower statutes and regulations, including retaliation and wrongful termination as well as fiscal and personnel management. David also brings a tremendous amount of real life expertise and knowledge to his role.

Donald Powelson, Office Managing Partner
Hanna, Brophy, MacLean, McAteer & Jensen, LLP

Donald Powelson is the Managing Partner of the Bakersfield Office of Hanna, Brophy, MacLean, McAteer & Jensen, LLP, a Senior Partner and a member of the firm's Executive Committee. He is a certified specialist in workers' compensation law who lectures on workers' compensation issues and the interaction between workers' compensation, the Americans' with Disabilities Act and the Family Medical Leave Act.
